These Terms & Conditions (“Terms”) govern the sale of frozen homemade meals (“Products”) by Caribbean Takeaway Limited (“we,” “us,” or “our”) to customers (“you” or “your”) via our online platform. By placing an order with us, you agree to be bound by these Terms.

1.5 We adhere to safe food-hygiene practices, including cleaning, cross-contamination control, chilling, and cooking, as required by UK food-safety guidance.
2. Product Information & Labelling
2.1 We provide for each Product:

2.3 We take reasonable steps to prevent allergen cross-contamination in food preparation, but our kitchen may handle a variety of ingredients.
2.4 For Products that require reheating, we will supply instructions for safe reheating, defrosting, and storing.
2.5 We supply storage instructions (e.g. “store at – 18°C or below”) on our packaging or accompanying documentation.
3. Orders & Contract Formation
3.1 Orders must be placed via our website (or any other ordering channel we support).
3.2 When placing an order, you must confirm that you have read and agree to these Terms.
3.3 After you submit an order, we will send an order confirmation via email indicating whether we can fulfil your request. The contract is formed when we confirm the order.
4. Pricing & Payment
4.1 Product prices are as displayed on our website when you place your order.
4.2 Delivery charges, if any, and any other applicable fees will be shown during checkout.
4.3 Payment must be made in full at the time of placing the order, using the payment methods we offer (e.g. credit/debit card, PayPal, etc.).
5. Delivery & Packaging
5.1 We deliver using couriers to the address you provide at checkout.
5.2 To maintain food safety, we package the Products in food-grade, insulated packaging (such as insulated boxes with coolants).
5.3 We will provide an estimated delivery date and/or time window at checkout.
5.4 Risk of loss or damage to Products passes to you once the courier delivers to your address.
5.5 If we use our own vehicle (rather than a third-party courier), it will comply with hygiene standards for transporting perishable food.
6. Cancellation, Refunds & Returns
6.1 Because Products are perishable frozen food, customers do not have a right to cancel just because they change their mind. Under UK regulations, perishable goods may be exempt from standard cancellation rights.
6.2 If delivered Products are damaged, thawed, or otherwise unfit, you must notify us immediately upon delivery, and provide dated photographic or other evidence.
6.3 If we agree there is a valid issue, we may offer a refund, a replacement, or other remedy at our discretion.
6.4 Refunds (when agreed) will be processed promptly, once we have verified the issue.
7. Liability
7.1 We follow strict food-safety procedures, but:

We cannot be held liable for misuse or incorrect storage of the food after you receive it.

We are not responsible for allergic reactions if you fail to read the allergen information provided.

Once delivery is complete, we are not liable for loss or damage to the Products.
7.2 Nothing in these Terms affects your legal rights under UK consumer protection laws, including the Consumer Rights Act 2015.
8. Safety, Recalls & Withdrawals
8.1 If we discover a food-safety problem (e.g., contamination), we reserve the right to recall or withdraw affected Products.
8.2 In such cases, we will contact customers who purchased the affected batches and provide safety instructions (e.g., how to dispose of the food).
9. Changes to Terms
9.1 We may update these Terms from time to time.
9.2 When we make significant changes, we will post the updated Terms on our website.
9.3 By continuing to place orders after a change, you accept the revised Terms.
10. Data Protection & Privacy
10.1 We collect personal data such as your name, address, and contact details for the purposes of processing orders.
10.2 We handle your data in accordance with our Privacy Policy and UK data protection law (e.g. UK GDPR).
10.3 We use your data only for business purposes (ordering, delivery, communication) and do not sell your personal data to third parties.
11. Intellectual Property
11.1 All content on our website (text, graphics, recipes) is owned by us or used under licence.
11.2 You may not reproduce, copy, or use our content for commercial purposes without our written permission.
12. Complaints & Dispute Resolution

13.2 Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England & Wales.
